Welcome to Kibely Garcia Photography. These Terms and Conditions ("Terms") govern your use of our website and the services we provide, including but not limited to photography sessions, image delivery, and other related services. By accessing or using our website, booking a session, or interacting with our services, you agree to comply with and be bound by these Terms.

If you do not agree with these Terms, please do not use our website or services.

1. Services Provided
We offer professional photography services, including but not limited to:

Portrait and family sessions

Engagement and wedding photography

Elopement sessions

Event and lifestyle photography

Photography consultations

These services are subject to availability, and booking a session with us confirms your acceptance of these Terms.

2. Booking and Payment
Retainer: A 50% non-refundable retainer is required to secure your session date and time. The remaining balance is due one week prior of the session unless otherwise agreed.

Payment Methods: We accept payments through credit cards, PayPal, cash app, Zelle and Venmo. Full payment for the session must be completed prior to or on the date of the session.

Cancellation and Rescheduling: Please refer to our Cancellation Policy for information regarding cancellations, rescheduling, and associated fees.

3. Client Responsibilities
Accuracy of Information: You are responsible for providing accurate contact information when booking a session. Please notify us of any changes to your contact details.

Session Preparation: We ask that clients arrive on time for their scheduled session. If you need to reschedule or are running late, please notify us as soon as possible.

Release of Images: By booking a session, you grant us permission to use the images for promotional and marketing purposes unless otherwise specified in writing.

4. Copyright and Usage of Images
Ownership: All images created during your session are owned by Kibely Garcia Photography. You will be granted a license to use the images for personal use only, including prints and digital sharing. Commercial use of the images requires explicit written consent from us.

Editing: We do not provide raw or unedited images. The final gallery will be delivered after professional editing, which reflects our creative style.

Usage Rights: You may not alter, crop, or modify the images in any way without prior written consent from us.

5. Delivery of Images
Turnaround Time: The standard turnaround time for galleries is 4 weeks, depending on the session type. Express delivery is available for an additional fee and will be delivered within 3 days of the session.

Gallery Access: You will receive a digital gallery link to view, download, and order prints of your photos. The gallery link will remain active for two weeks. After this period, we may charge a fee for additional access.

6. Weather and Force Majeure
In the event of bad weather or other circumstances beyond our control, we reserve the right to reschedule sessions. Rescheduling due to weather does not incur a fee, and we will make reasonable efforts to accommodate a new session date.

7. Limitation of Liability
While we take every care to ensure the safety of our equipment and the quality of our services, Kibely Garcia Photography will not be held liable for any injury, loss, or damage during a session. We are also not responsible for any third-party actions that may interfere with the photoshoot or the final delivery of images.

8. Privacy and Data Protection
Please refer to our Privacy Policy for information on how we collect, use, and protect your personal data.

9. Amendments to These Terms
We reserve the right to modify or update these Terms and Conditions at any time. Any changes will be posted on this page, and the revised version will take effect immediately upon posting. Please review these Terms periodically.

10. Governing Law
These Terms and Conditions are governed by the laws of Kansas, United States Of America. Any disputes related to these Terms will be resolved in the appropriate courts of Kansas, United States Of America.

Cancellation and Rescheduling Policy
Cancellation by Client: If you cancel your session more than 4 days in advance, you will be refunded 50% of your deposit. Cancellations within 3 days of the session will result in no refund.

Rescheduling by Client: If you need to reschedule, please notify us as soon as possible. Rescheduling due to weather is free of charge, but rescheduling for other reasons will incur a $50 rescheduling fee..
